You mean if you don't get the hat can you sue them? Probably not, based on whatever you have to agree on when pre-ordering.

Hell, I believe Valve's basic Steam contract entails it having no legal responsibility to deliver goods. The whole thing's kind of farcical.

Some clauses may be not applicable everywhere. Seeing that Valve is an American company and most Western European countries have much stricter contract law.
